Terms & Conditions

In these Terms: We, us, our means Row Group Holdings Limited (Company Number 14331185, whose registered office is 1 Fore Street Avenue, London, EC2Y 9DT), trading as Wellverse. We supply all Sessions subject to these Terms. You, your, yours means you, the client.

1. Important Information About Data Protection

The nature of our business and the provision by us of Sessions to you means that we will collect and process certain of your personal data from time to time. We will only do so in accordance with our Privacy Notice, which you can read by clicking the following link: Privacy Policy.

2. Health and Safety

Many of our Sessions involve strenuous physical activity and we recommend that you seek medical advice before attending or participating in a Session (including online). For your own safety and the safety of others we rely on you using our facilities and premises and participating in our Sessions (including online) in the intended manner and your acceptance of these Terms constitutes your confirmation that you will do so, that you will comply with our reasonable instructions in relation to your attendance at our premises or participation in a Session and that you agree to the content of our Health and Safety Statement, a copy of which you can view here.

Without limitation to the foregoing:

  • you must inform us, and where relevant the instructor, before the start of a Session if you have any injury, medical condition, are pregnant, postnatal, or have any other condition which may affect your ability to participate safely;
  • attendance at all Sessions is at your own discretion and, where appropriate, in consultation with your doctor or other qualified healthcare professional;
  • if you are attending postnatal Sessions or returning to exercise following childbirth, you must have completed your postnatal check with a healthcare professional before attending any Session. This will typically be around 6 weeks after a vaginal birth and 8 weeks after a caesarean section, although timing may vary;
  • certain Sessions may be subject to additional health and safety requirements or waivers, including infrared Sessions. Infrared Sessions are not suitable during pregnancy and may also not be suitable for individuals with cardiovascular conditions, blood pressure concerns or blood sugar conditions. Clients attending infrared classes may be asked to complete a waiver before participating;
  • where we specify that a Session is not appropriate for a particular condition, level or participant group, you must not attend that Session.

3. Your Account With Us

In order to book Sessions you must sign up for an account through our Website or such other digital booking platform as we may make available from time to time.

You must be at least 16 years of age to attend any Sessions.

You are responsible for ensuring that the details held on your Account are accurate and up to date. Where we migrate or consolidate booking systems or platforms, you may be required to reset your password or take such other steps as we notify you of in order to access your Account.

4. Sessions and Use of Our Premises

  • Our Sessions include, without limitation, classes, workshops, events and classes available online.
  • In booking a Session you agree to comply with any additional rules we may make known to you in relation to the Session from time to time, including how you may use our premises, facilities and your conduct whilst doing so.
  • All Sessions, instructors, class formats, studio locations, facilities and timetables are subject to change from time to time, even after you have booked. We will let you know about any changes as soon as we reasonably can, either via email, SMS, app notification, telephone, website notice or otherwise.
  • Access to our premises, Sessions and any other goods and services we may supply from time to time is at our discretion and we reserve the right to refuse you access to any of the same, or to suspend or otherwise terminate your Account if we consider that you are in breach of these Terms, the Session Rules or your behaviour at our premises is inappropriate, aggressive, rude, threatening, unsafe or otherwise damaging to our customers, staff or our reputation more generally. If we do so you will not be entitled to any refund except where required by law.
  • We may operate different rules for different Session types, products, equipment, facilities and studio locations, including without limitation in relation to lateness, guest access, specialist equipment, grip socks, infrared participation and studio-specific access.

5. Different Types of Membership

We offer different types of credits, class packs, subscriptions and memberships, which may change from time to time and which may offer you different ways of paying for and accessing Sessions.

These may include, without limitation:

  • pay-as-you-go credits;
  • class packages;
  • monthly memberships with a specified number of credits per billing month;
  • Signature memberships;
  • All In memberships;
  • annual memberships; and
  • introductory offers.

6. Credits

  • The cost of each Session varies depending on type, content, location and product, and you will need to purchase or hold the appropriate credit in order to attend the relevant Session.
  • You will be able to see the type of credit required for each Session and the cost of that credit at the time you book a Session.
  • Details of all credits, memberships, packs, add-ons and their price are set out on our Website or app, including whether they are studio-specific, product-specific or capable of being used across all or some of our premises.
  • Subject to these Terms and your right to cancel under section 8 below, all credits are non-refundable and non-transferable.
  • All credits purchased will have an expiry date shown in your Account and must be used before that expiry date.
  • From time to time we may offer promotional pricing or other offers, and any credits purchased in this way may have a shorter expiry period.
  • Where we make top-up credits available to members, such credits shall expire on your usual billing date and shall not roll over unless we expressly state otherwise.
  • Subject to section 15 below, sale or promotional class packs may not be extended.

7. Payment Terms

  • Pay-as-you-go credits, packs and add-ons may be paid for by debit card, credit card or such other payment methods as we make available through our checkout process.
  • Monthly memberships, subscriptions and recurring memberships shall be paid for by debit card, credit card or such other method as we may permit. Your first payment will be processed on the date you sign up, and subsequent payments will be processed on the same day in each subsequent month, or the nearest equivalent day where applicable.
  • If any payment is unsuccessful, we may notify you and, if payment is not rectified within such period as we specify, we may suspend or cancel your membership and/or charge any booked Sessions at the applicable pay-as-you-go rate.
  • Unless expressly stated otherwise at the point of purchase, memberships are rolling monthly.
  • We reserve the right to review and change pricing and fees from time to time on notice.

8. Cooling Off Period

  • Where you have purchased credits, a package, an introductory offer, a monthly membership, an annual membership or any similar product online, you may cancel your purchase within 14 days of the date of purchase by contacting us through one of our studios, in person, by telephone, by email or through the relevant contact channel on our Website.
  • If you cancel during the cooling-off period and have not used any credits, attended any Sessions or otherwise consumed any part of the service purchased, you will be refunded the full charge for the relevant purchase.
  • If you cancel during the cooling-off period and have used any credits, attended any Sessions or otherwise consumed any part of the service purchased, you will be refunded the full charge less the value of any Sessions attended, booked or otherwise used prior to cancellation, to the extent permitted by law.

9. Booking Sessions

All Sessions must be booked through your Account or such other booking mechanism as we may make available. In order to book a Session you must either:

  • have at least one appropriate credit in your Account for the Session you would like to book; or
  • purchase an appropriate credit or product during the booking journey; or
  • hold a valid membership or pack which includes the Session.
  • Your booking is only confirmed once you have received confirmation from us by email, app, SMS or the Session appears in the relevant section of your Account.
  • Sessions may generally be booked up to 14 days in advance, save that where we offer an All In membership or other priority booking product, we may offer an extended booking window of up to 21 days or such other period as we notify you at the time.
  • Certain workshops, events or special sessions may be released on different dates and may be booked further in advance.
  • All Sessions are subject to availability and we cannot guarantee that you will be able to book any particular Session.
  • If a Session is fully booked, you may join a waitlist. If a place becomes available, we may automatically add you to the Session and notify you by email, SMS or app notification. Once you are moved from the waitlist into the Session, the standard cancellation policy will apply.
  • You are responsible for removing yourself from a waitlist if you no longer wish to attend.
  • We may permit bookings through third-party platforms, but where you book through a third party, changes, cancellations, refunds, credits and grace periods may be subject to that third party's rules and systems and not ours.

10. Changing or Cancelling Your Bookings and No Shows

  • You may cancel your booking for a standard Session without charge up to 12 hours before the scheduled start time of that Session. You may cancel a workshop or event without charge up to 48 hours before the scheduled start time, unless otherwise stated at the point of booking.
  • If you cancel a standard Session within 12 hours of its start time, this shall constitute a late cancellation.
  • If you do not attend a booked Session, this shall constitute a no-show.
  • For clients booking under a membership product, late cancellation and no-show fees shall apply as set out on our Website or at the time of booking. As at the date of these Terms, the policy is: (i) late cancellation: £7.50 fee, with the class credit returned; (ii) no-show: £12.50 fee, with the class credit returned. For clients booking under a credit pack or class pack, the relevant class credit will be deducted and no additional fee shall be charged.
  • Where we offer goodwill exemptions, these shall be administered at our discretion and in accordance with the policy published from time to time.
  • If you booked through a third-party platform, we are unable to amend, cancel or apply grace periods to your booking and you must contact the third-party provider directly.
  • Save where required by law or expressly stated in these Terms, classes, memberships and credit packs are non-refundable.

11. Lateness Policy

For safety, fairness and the proper running of Sessions, late entry rules may vary by Session type or studio location.

  • For certain Sessions, entry may be permitted up to 5 minutes after the scheduled start time.
  • For certain Sessions, no late entry is permitted.
  • Where you arrive late and are refused entry, standard cancellation or no-show consequences may apply and no refund shall be given unless we decide otherwise in our discretion.

12. If We Cancel Your Booking

If we cancel a Session that you have booked, we will use reasonable efforts to notify you. We may offer you the option to transfer to another equivalent Session, receive a replacement credit, or such other remedy as we consider appropriate in the circumstances.

13. Liability

We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable, or for loss or damage which is your own fault or which is attributable to a third party unconnected with the provision of our services.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

Please note that we cannot be held responsible for your personal belongings whilst at our premises. Lost property will only be retained for such period as we specify from time to time.

14. Membership Fee Changes

We reserve the right to review and change membership fees, Session fees, cancellation fees, no-show fees, freeze fees, extension fees and other charges from time to time. Any updated fees will apply from the date specified by us.

15. Monthly Subscriptions, Memberships, Freezes and Extensions

The following additional terms apply where you elect to purchase a monthly subscription or membership:

  • where you elect to purchase a monthly subscription or membership, you will receive the number and type of credits applicable to that product during each billing cycle;
  • unless expressly stated otherwise, credits allocated to a given billing cycle will expire at the end of that billing cycle and will not roll over;
  • you may purchase additional Sessions or top-up credits where such products are offered by us;
  • details of the Sessions included, product restrictions, studio restrictions, guest entitlements, workshop entitlements and any other limitations applicable to your product shall be set out at the point of purchase or in your confirmation email;
  • memberships may be frozen only by our community team, by email, phone or in studio, and not retrospectively;
  • unless otherwise stated, the freeze allowance is as follows: (i) All In members: up to two one-month freezes per year; (ii) other memberships: up to one one-month freeze per year;
  • we may from time to time offer paid freezes. As at the date of these Terms, paid freeze fees are: (i) All In: £50; (ii) Signature: £25;
  • longer freezes or exceptions may be permitted for pregnancy or illness where appropriate evidence is provided;
  • where we allow class pack extensions, these may only be processed by our community team, by email, phone or in studio, and are subject to our extension policy from time to time. As at the date of these Terms: (i) one free two-week extension may be granted per year; (ii) sale or promotional packs may not be extended; (iv) paid one-month extensions may be offered according to the number of credits remaining on the pack;
  • unless otherwise stated at the point of purchase, memberships are for individual use only and may not be shared.

16. Guests, Buddy Bookings and Introductory Products

  • Unless otherwise stated, memberships and intro offers are for individual use only and do not include guest bookings.
  • Where we make guest passes or "bring a buddy" products available, they shall be subject to the conditions specified by us at the relevant time, including any requirement that the guest has or creates an account with us.
  • Class packs may permit guest bookings where expressly stated by us.
  • Introductory offers may have separate rules, including visit caps, validity periods, access limits and personal-use restrictions.

17. Use of Premises, Facilities and Studio Rules

  • You must comply with all studio rules and signage in force at the relevant premises.
  • Only closed-top water bottles are permitted inside studio spaces.
  • Grip socks are mandatory for such Sessions as we may specify from time to time.
  • Dogs, bicycles and unattended children are not permitted in the studio unless we expressly agree otherwise.
  • Facilities vary by studio, and accessibility also varies by location.

18. Promotional Offers and Discount Codes

From time to time we may run promotions, prize draws, referral offers, discount code offers or other campaigns. We may implement separate terms and conditions in respect of any such promotion and will advise you accordingly where this is the case.

Notwithstanding the above:

  • we reserve the right to end, amend or withdraw any promotion or discount code at any time;
  • we reserve the right to withdraw your right to participate in or benefit from any promotion or discount code if we consider, in our absolute discretion, that you have abused, misused or gained an unfair advantage in respect of it; and
  • we reserve the right not to honour future bookings or benefits associated with any promotion or code where misuse is identified.

19. How We Can Contact Each Other

By you: any written notice, enquiry or feedback should be provided using our contact form, by email to the relevant studio or by such other means as we make available.

By us: we may contact you using any of the contact details you provide to us when you create an account, make a booking or purchase a membership, including by email, telephone, SMS or app notification.

20. Force Majeure

We shall not be liable to you or deemed to be in breach of these Terms by reason of any delay in performing or any failure to perform any of our obligations if the delay or failure was due to any cause beyond our reasonable control, including without limitation acts of God, flood, storm, fire, war, terrorism, riot, civil disturbance, governmental restrictions, industrial action, failure of telecommunications or IT systems, epidemic, pandemic, civil emergency, power failure or breakdown of equipment or machinery.

Where all or a material part of our studios are closed for a period due to any cause beyond our reasonable control, we may grant freezes, credits, extensions or such alternative remedies as we consider appropriate in the circumstances.

21. Waiver

No delay or failure by either party to exercise any of its powers, rights or remedies under these Terms will operate as a waiver of them, nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver, to be effective, must be in writing.

22. Severability

If any part of these Terms is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable, such part will be severed from these Terms and the remainder will continue to be valid and enforceable to the fullest extent permitted by law.

23. Entire Agreement

These Terms, together with our Privacy Notice, Health and Safety Statement, any waiver applicable to a Session, and any additional policies we have in force from time to time, constitute the entire agreement between you and us.

24. Third Party Rights

These Terms constitute a contract between you and us. No other person shall have the right to enforce any of these Terms.

25. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with English law and the parties agree to submit to the exclusive jurisdiction of the English courts.
